Acceptance of the Agreement
The term "That Design Studio" or "us" or "we" or "our" refers to That Design Studio LLC (a.k.a. Heather Munsell DBA That Design Studio), the owner of the That Design Studio website. The term "you" refers to the user or viewer of the website. By using or viewing the That Design Studio website, you agree to the terms and conditions outlined in this Terms of Use Agreement. This agreement constitutes the entire agreement between the parties, and supersedes all other agreements, written, oral, or implied, regarding this site, its content, products or services provided by or through this site. This agreement is subject to change at any time by That Design Studio without notice. The most current version of the agreement will be posted on this site, and should be reviewed prior to using the site, if necessary.

Indemnification
You agree to indemnify, defend and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, attorneys, advertisers, product and service providers, and affiliates harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this agreement and/or use of this site.
Nontransferable
Your right to use the Site is not transferable or assignable. Any password or right given to you to obtain information or documents is not transferable or assignable.
Disclaimer and Limitation of Liability
All content and information available on this site is "as-is" and we shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from your use of this site.
Use of Information
We reserve the right, and you authorize us, to the use all information provided by you in any manner consistent with our Privacy Policy. All materials and ideas submitted to That Design Studio become the property of That Design Studio to use however That Design Studio deems appropriate, for both commercial and non-commerical use.
Any materials or ideas generated by That Design Studio (i.e. design comps and sample ideas) before a Project Agreement is signed are the intellectual property of That Design Studio and remain the property of That Design Studio until an appropriate Project Agreement is signed by both parties. In the event that a Project Agreement is not signed, use of any of these materials in whole or in part, without proper Written Copyright Use Permission constitutes a violation of copyright laws and may result in legal action for copyright infringement.
All materials produced by That Design Studio, regardless of final project completion, status or contractual agreement for use, may, at any time, be used by That Design Studio for portfolio purposes and/or published online on the That Design Studio website as samples of work.
Privacy Policy
Our Privacy Policy is subject to change at any time. You are responsible for being aware of the policy prior to use of this site.
Payments
You warrant that if you are purchasing any goods or services from That Design Studio any credit information you supply is true and complete, charges incurred by you will be honored by your credit card company, and you will pay the charges incurred by you at the posted prices, including any applicable taxes and fees. Our Billing Policies are subject to change at any time. Billing policies can be found in your project agreement. You are responsible for being aware of the policies prior to use of this site. Any changes to billing for a specific project agreement will be handled in writing only between the involved parties.

This agreement is to be construed in accordance with the laws of the State of Montana, United States of America, and all parties hereto agree to be legally bound thereby.
